Terms of Service

These terms (the “Terms”) govern your use of istPositive (the “Service”). By using the Service you agree to them. If you do not agree, please do not use the Service.

1. The Service

istPositive accepts a photograph of an at-home pregnancy test and returns an estimated reading (positive, negative, or inconclusive) with a confidence score. The reading is generated by a machine-learning vision model and reflects only what the model can infer from the image you provide.

2. Account & eligibility

  • You confirm you are at least 18 years old.
  • You confirm you are using the Service for yourself or that the person depicted has given you informed consent to upload their test and have it processed (see § 4).
  • We use magic-link authentication. You are responsible for keeping access to your sign-in email secure.

3. Acceptable use

You will not:

  • scrape, crawl, or systematically harvest the Service;
  • share, sell, or transfer your account credentials or magic links to another person;
  • upload photos depicting another person's test without their informed consent;
  • upload images that are unlawful, sexual, or that depict minors in any context;
  • attempt to reverse-engineer, defeat rate limits, or otherwise interfere with the Service;
  • use the Service to make clinical decisions for third parties.

We may suspend or terminate accounts that breach this section without refund.

4. Health data & consent

Each scan requires your explicit consent to process special-category health data. The full data flow is described in our Privacy Policy. Withdrawing consent is instantaneous: stop uploading, and delete saved results from your account.

5. Plans, payments, refunds

Pricing is shown on the pricing page. We currently offer single-use reads and recurring subscriptions billed through Stripe. Subscriptions renew until cancelled.

Refunds are governed by our Refund Policy, which incorporates the EU 14-day right of withdrawal where applicable.

6. Intellectual property

The Service, including its design, code, and brand, is owned by istPositive. You retain all rights to the photographs you upload. By uploading, you grant us a limited, revocable licence to process the image solely to deliver the Service to you and as described in the Privacy Policy.

7. Disclaimer of warranties

The Service is provided “as is” and “as available”. We do not warrant that readings will be accurate, uninterrupted, or error-free. The confidence score is a model estimate, not a clinical assessment. Lighting, test brand, faded lines, and evaporation lines can all affect the reading.

8. Limitation of liability

To the maximum extent permitted by law, istPositive and its officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability for any direct damages is capped at the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) one hundred euro (€100).

Nothing in these Terms excludes liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, or for fraud.

9. Indemnity

You agree to indemnify istPositive against claims arising from your breach of these Terms or your unlawful use of the Service.

10. Termination & data export

You may terminate at any time by deleting your account. We may terminate or suspend access for breach of these Terms or for legal reasons. On termination, you have 30 days to request a data export under our Privacy Policy.

11. Changes to the Terms

Material changes are announced at least 30 days in advance by email to account holders. Continued use after the effective date is acceptance.

12. Governing law

(Placeholder — jurisdiction to be confirmed before public launch.) These Terms are governed by the laws of the jurisdiction of our operating entity, without regard to conflict-of-laws principles. Mandatory consumer-protection rights of your country of residence are not affected.
